Conflicto de competencia suscitado entre el Tribunal Administrativo de Santander y el Tribunal para la Paz, Sección de Revisión – Subsección Primera de Tutelas.
La controversia se generó por las diferentes interpretaciones que hicieron los despachos involucrados del factor funcional.
La Corte considera que el Tribunal Administrativo fue el que infringió la regla de competencia a prevención, en tanto debió decidir de fondo desde el momento en que, por reparto, llegó a su despacho la acción de tutela, sin desprenderse de su conocimiento.
Se ordena remitir el expediente a dicha Corporación para que de manera inmediata tramite y adopte la decisión de fondo que corresponda.

- Primero. DEJAR SIN EFECTOS el 26 de febrero de 2019 por el Tribunal Administrativo de Santander, dentro de la accion de tutela formulada por Martin Arias Ortega.
- Segundo. REMITIR el expediente ICC-3591 al Tribunal Administrativo de Santander, para que de manera inmediata, tramite y adopte la decision de fondo a que haya lugar.
- Tercero. Por la Secretaria General de la Corporacion, COMUNICAR a la parte demandante y al Tribunal para la Paz, Seccion de Revision - Subseccion Primera de Tutelas la presente decision.
